Terms of Service

Last updated: October 14, 2026

By accessing or using CatchLead ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Service Description

CatchLead provides an AI-powered sales agent platform for businesses. The Service includes AI voice and text chat agents, lead capture, appointment booking, and related business automation tools deployed on your website.

2. AI-Generated Content Disclaimer

IMPORTANT: The AI agents provided by CatchLead use artificial intelligence (powered by Google Gemini) to generate responses in real time. AI-generated content may contain inaccuracies, errors, or hallucinations.

You acknowledge and agree that:

  • No guarantee of accuracy. CatchLead does not warrant that AI-generated responses, price quotes, estimates, scheduling information, or any other content produced by the AI agent will be accurate, complete, current, or error-free.
  • AI hallucinations. AI models may generate responses that sound confident but contain fabricated information, including but not limited to: incorrect pricing, inaccurate service descriptions, fictitious availability, made-up policies, or information about services your business does not actually offer.
  • Not professional advice. AI-generated content does not constitute professional, legal, medical, financial, or technical advice. Users and their customers should independently verify all information provided by the AI agent.
  • Your responsibility to configure. You are solely responsible for configuring your AI agent with accurate business information, pricing, service offerings, and business hours. CatchLead is not liable for errors resulting from incomplete, outdated, or incorrect configuration data provided by you.
  • Your responsibility to monitor. You are responsible for reviewing conversation transcripts and correcting any errors or misleading information communicated by the AI agent to your customers. CatchLead provides dashboard tools for this purpose.
  • Customer communications. You are solely responsible for all communications between the AI agent and your customers. If the AI agent provides incorrect information to your customer (including but not limited to wrong pricing, unavailable services, or incorrect scheduling), you are responsible for resolving any resulting disputes with your customers.

3. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • CatchLead, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of revenue, loss of business, loss of customers, loss of data, or loss of goodwill, arising out of or in connection with the use of the Service, even if CatchLead has been advised of the possibility of such damages.
  • CatchLead shall not be liable for any damages arising from:
    • Inaccurate, misleading, or fabricated information generated by the AI agent
    • Pricing errors or incorrect estimates communicated by the AI agent
    • Missed appointments or scheduling errors
    • Loss of potential leads or customers
    • Decisions made by you or your customers based on AI-generated content
    • Any disputes between you and your customers arising from AI agent interactions
    • Service interruptions, downtime, or technical failures
    • Unauthorized access to or alteration of your data
  • Total liability cap. In no event shall CatchLead's total cumulative liability to you exceed the amount you have paid to CatchLead in the twelve (12) months preceding the claim.

4. Indemnification

You agree to indemnify, defend, and hold harmless CatchLead and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Service
  • Any content or information generated by the AI agent on your behalf
  • Any disputes between you and your customers
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Inaccurate business information you provided to configure the AI agent

5. Subscription Plans & Billing

CatchLead offers subscription plans with the following general terms:

  • Free trial. New accounts receive a 14-day free trial with full Pro features, except that voice is limited to 50 voice conversations during the trial. No credit card is required to start a trial.
  • Billing cycle. Subscriptions are billed monthly. Charges are processed through Stripe.
  • Monthly allowance. Each plan includes a number of conversations and voice minutes per calendar month, shown on the pricing page and in your dashboard. A conversation is one visitor's chat or call with your assistant, however many messages it has. Conversations beyond the allowance are billed at the rate shown on the pricing page ($0.50 each at launch) on your next invoice. Voice pauses when the voice minutes run out and resumes on the 1st; typed chat keeps working. To protect the Service, the assistant may stop answering for the rest of the month at 2.5 times the conversation allowance.
  • Founding price. Businesses that subscribe while the Founding offer is open keep the Founding price for 12 months from their first paid month. After that, the subscription moves to the then-current price with 30 days' email notice.
  • Usage-based channels and add-ons. Some channels and features cost us per use, such as text messages, phone minutes and WhatsApp messages. When they are offered, they may be billed separately through usage credits or as add-ons, at prices shown before you turn them on. Nothing is charged for a channel or add-on you have not turned on.
  • Invoicing and card payments. When invoicing is offered and you turn it on, your customers pay your invoices through your own Stripe account, and the money goes from Stripe to your bank. Stripe's card processing fees are yours and are taken by Stripe. CatchLead charges a fee of 0.5% of each invoice paid by card (before sales tax), taken automatically from that payment. No fee is charged on invoices you mark as paid by cash, check or other means. Sales tax, if you turn it on, is worked out by Stripe Tax under your own Stripe account; you are responsible for registering for, charging and filing the taxes that apply to your business. Refunds and disputes are handled in your Stripe account; CatchLead's fee is not returned on refunded payments unless Stripe returns it to us.
  • Plan changes. If more plans are offered, you may switch at any time; changes take effect at the start of the next billing cycle. Features included in the plan you pay for are not removed from it during your current price period.
  • Cancellation. You may cancel your subscription at any time from your dashboard. Access continues until the end of the current billing period. No refunds are issued for partial months.
  • Price changes. CatchLead may change prices, allowances and usage rates with 30 days' email notice to the account's email address. Changes apply from your next billing period after the notice ends; a locked Founding price is not changed before its 12 months end. Continued use after a change takes effect means you accept it.

11. Termination

CatchLead may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service immediately ceases. Sections 2 (AI Disclaimer), 3 (Limitation of Liability), 4 (Indemnification), and 10 (Disclaimer) survive termination.

12. Modifications to Terms

CatchLead reserves the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Service. Continued use after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
